These Terms of Service (“Terms”) govern access to and use of the CrowdifAI websites, mobile applications, APIs, marketplace, task/contribution services, datasets, downloads, seller tools, payout tools and related services (collectively, the “Service”).

Please read these Terms together with our Privacy Policy, Refund & Cancellation Policy, Creator/Seller Terms, Dataset License Terms, KYC & Identity Verification Privacy Notice and Community & Content Policy. Additional terms displayed for a specific task, dataset, enterprise order, promotion or purchase also form part of the applicable agreement.

1. Acceptance of these Terms

By creating an account, checking an acceptance box, buying a dataset, submitting data, accepting a task, creating a marketplace listing, receiving a payout, or otherwise using the Service, you agree to these Terms.

If you use CrowdifAI for a company or other organization, you represent that you have authority to bind that organization. In that case, “you” includes that organization where appropriate.

If you do not agree to these Terms, do not create an account or use the Service.

2. Eligibility and age

You must be at least 18 years old and legally capable of entering into binding contracts to use CrowdifAI, unless CrowdifAI expressly launches a different age policy for a specific jurisdiction with appropriate safeguards.

You may not use the Service if applicable law prohibits you from receiving the Service, making the relevant payment, receiving a payout, or licensing the relevant content.

We may request information reasonably necessary to verify age, identity, authority, sanctions status, tax status, payout eligibility or compliance with law.

3. Accounts and security

You must provide accurate information and keep it reasonably current. You are responsible for activity performed through your account unless caused by CrowdifAI’s breach of applicable law or security obligations.

You must:

  • protect passwords, passkeys, authentication tokens and recovery methods;
  • promptly notify us of suspected unauthorized access;
  • not share an account in a way that bypasses role, security or licensing restrictions; and
  • not create accounts using false identity information or for fraudulent purposes.

We may use email verification, device/session monitoring, step-up authentication, passkeys, KYC and other safeguards to protect accounts and transactions.

4. What CrowdifAI provides

Depending on your role and region, CrowdifAI may allow you to:

  • upload and organize datasets and individual data files;
  • annotate, review or contribute data to tasks;
  • choose permitted data-use purposes and licensing settings;
  • create marketplace listings;
  • discover, preview and license datasets;
  • purchase downloads or commercial dataset licenses;
  • earn task rewards or seller proceeds;
  • connect a payout account;
  • use collaboration, enterprise, notification and support features; and
  • export or delete account information subject to lawful retention requirements.

Features may differ by country, platform, account type, verification status and app-store rules.

5. CrowdifAI’s marketplace role

CrowdifAI provides technology that connects data creators/sellers with buyers and may also sell or license CrowdifAI-owned datasets. The identity of the seller/licensor and the applicable license should be shown in the listing, checkout confirmation, invoice or other transaction record.

Unless CrowdifAI is expressly identified as the seller/licensor, the creator/seller is responsible for the accuracy, provenance, rights and listing claims for its dataset. CrowdifAI may review, moderate, package or approve listings, but such review does not transfer the creator’s legal responsibilities to CrowdifAI and is not a guarantee that a dataset is error-free, complete, anonymous, lawful for every intended use, or suitable for a particular model or project.

Where applicable law treats CrowdifAI as the contracting seller, marketplace operator, merchant, digital-content provider or other regulated intermediary despite the description above, those mandatory legal obligations continue to apply.

6. User content and uploaded data

“User Content” means datasets, images, videos, audio, text, documents, annotations, labels, metadata, reviews, stories, listing information and other material you submit to the Service.

You retain ownership of rights you already hold in your User Content. You are responsible for ensuring you have all rights, permissions, releases and lawful bases necessary to upload and license it.

For each upload, you represent and warrant that, as applicable:

  1. you created the content, own the relevant rights, have a sufficient license, the material is lawfully in the public domain, or you have appropriate employer/organization authorization;
  2. your submission does not knowingly infringe copyright, database rights, trade secrets, privacy, publicity, confidentiality or other third-party rights;
  3. you have obtained any required consent or other lawful basis for identifiable people represented in the content;
  4. you are permitted to grant the permissions and licenses selected in CrowdifAI; and
  5. information you provide about provenance, restrictions, labels and licensing is accurate to the best of your knowledge.

Do not upload passwords, authentication secrets, private financial credentials, medical records, highly confidential business data, unlawfully obtained personal data, or other restricted information unless a specific CrowdifAI task expressly requests it and the submission is lawful and appropriately protected.

7. License you grant to CrowdifAI

To operate the Service, you grant CrowdifAI a non-exclusive, worldwide license to host, store, reproduce, format, transcode, validate, scan, review, annotate, package, display limited previews of, transmit and otherwise technically process User Content as reasonably necessary to provide, secure and administer the Service.

For User Content that you elect to contribute for research, AI training, marketplace, commercial or partner use, you additionally grant the rights you affirmatively select in the Service, subject to the selected scope, duration, exclusivity and compensation settings and any applicable Creator/Seller Terms.

The operational license needed to maintain transaction records, backups, legal evidence, already-created buyer packages, abuse investigations and compliance records may continue after account deletion only to the extent necessary and permitted by law.

Where a valid paid buyer license has already been granted before you change or withdraw a future-facing setting, that buyer’s existing contractual rights do not automatically terminate unless the applicable license expressly provides otherwise or law requires it. CrowdifAI will stop new processing or licensing that relies on a withdrawn consent where required by data-protection law.

8. Privacy choices are different from contractual licenses

CrowdifAI provides granular controls for data types, processing purposes, license type, duration and compensation. Some controls may constitute privacy consent; others define contractual permissions or licenses.

Withdrawing optional privacy consent applies prospectively as required by law. It does not require CrowdifAI to erase records that must be retained for payments, tax, fraud prevention, legal claims, security, or completed transactions. It also does not retroactively cancel rights already lawfully granted to a buyer unless applicable law or the specific license requires that result.

9. Dataset tiers and licenses

CrowdifAI currently distinguishes between:

  • **Basic / Scientific** datasets, intended for the scientific or non-commercial scope described in the applicable listing; and
  • **Premium / Commercial** datasets, for commercial use within the scope of the applicable Dataset License Terms and listing.

The label “Basic,” “Scientific,” “Premium,” or “Commercial” is not by itself a complete license. The listing, Dataset License Terms and any order-specific terms determine the actual permitted use.

Unless expressly permitted, buyers may not resell, sublicense, publish, mirror, disclose or redistribute raw datasets or substantially equivalent copies to third parties.

10. Marketplace listings and moderation

Creators may be required to complete email verification, consent steps, KYC or other eligibility checks before publishing or receiving money.

CrowdifAI may review, reject, suspend, unpublish, relabel or remove a listing where reasonably necessary for quality, rights, safety, fraud, legal or policy reasons. We may request evidence of ownership, releases, provenance, licensing authority or dataset quality.

Approval of a listing is not legal advice, an endorsement, or a warranty that all creator representations are correct.

11. Prices, fees and taxes

Prices are displayed before purchase in the applicable currency. Unless stated otherwise, prices do not include taxes that must be separately collected under applicable law.

CrowdifAI may charge a marketplace/platform fee to sellers and may change the fee for future transactions. The current fee or method of calculation must be disclosed in the seller interface or applicable Seller Terms before the relevant transaction.

You are responsible for taxes, reporting and other obligations arising from your purchases, sales or earnings except taxes that CrowdifAI is legally required to collect, withhold or remit.

12. Buyer payments

Depending on platform and country, payments may be processed through Apple In-App Purchase, Google Play Billing, Stripe, or another payment method permitted by applicable law and app-store rules.

By submitting an order, you authorize the applicable payment provider to charge the displayed amount and applicable taxes/fees. Payment providers may impose their own terms and privacy practices.

For store-billed transactions, Apple’s or Google’s billing, refund and purchase-management rules apply in addition to these Terms.

For direct CrowdifAI/Stripe transactions, the Refund & Cancellation Policy applies.

13. Digital delivery and right of withdrawal

Datasets are digital content. Delivery may occur by unlocking a download, generating a package, granting an entitlement, issuing a download token, or otherwise making the purchased data/license available.

Where consumer law provides a withdrawal/cooling-off right for digital content, CrowdifAI will obtain any consent and acknowledgement required to begin immediate delivery and to end the withdrawal right. If the legally required consent/acknowledgement is not obtained, your statutory withdrawal rights are unaffected.

Nothing in these Terms excludes a refund, withdrawal, cancellation, conformity remedy or other consumer right that cannot lawfully be excluded.

14. Refunds

Except where required by applicable law, app-store rules or the Refund & Cancellation Policy, direct digital dataset purchases are final after digital delivery/access begins.

This means a change of mind after a dataset has been made available or downloaded generally does not qualify for a refund to the extent permitted by law.

We may nevertheless provide a refund or other remedy for circumstances including duplicate or unauthorized charges, failure to deliver, a materially corrupt/inaccessible package that we cannot cure, or material misdescription, as described in the Refund & Cancellation Policy.

Apple- or Google-processed purchases remain subject to the platform’s refund process and mandatory consumer law. CrowdifAI does not override a refund lawfully issued by the platform.

15. Creator earnings and task rewards

Creator earnings can arise from marketplace sales, approved contribution tasks, referral programs or other programs expressly offered by CrowdifAI.

An estimated, pending or displayed balance is not a guaranteed payout. Amounts may remain pending while submissions, fraud signals, buyer payment status, chargebacks, delivery, KYC, minimum payout thresholds or other required checks are resolved.

For task rewards, CrowdifAI may accept or reject submissions against the task instructions, quality criteria, duplication controls and review process disclosed for the task. Fraudulent, fabricated, duplicated, automated, rights-infringing or otherwise invalid submissions are not eligible for payment.

CrowdifAI does not guarantee any minimum number of tasks, sales, buyers, revenue or earnings.

16. Payouts, KYC and payment reversals

Payouts may require:

  • completed identity verification/KYC;
  • an eligible connected payout account;
  • satisfaction of a minimum payout amount;
  • expiration of applicable review/hold periods;
  • valid tax/payment information; and
  • compliance with applicable law and provider requirements.

If a buyer payment is refunded, reversed, disputed or charged back, or a transaction is determined to be fraudulent or invalid, the related seller amount may be withheld, reversed, deducted from a future payout, or recovered from the seller to the extent permitted by law and the applicable Seller Terms.

Payment and payout providers may delay or reject transactions for compliance, sanctions, banking or risk reasons outside CrowdifAI’s direct control.

17. KYC and automated verification

CrowdifAI may require identity documents, selfies, identity-provider verification and automated liveness/quality/fraud analysis to protect the marketplace and enable payouts.

Automated signals may assist the review process. Where required by law or CrowdifAI policy, users can request human review of an adverse KYC outcome through [KYC SUPPORT CHANNEL].

18. Prohibited conduct

You must not:

  • upload or sell material you do not have authority to use/license;
  • submit unlawful, stolen, deceptive, malicious or fraudulently generated content;
  • intentionally include undisclosed personal, confidential or security-sensitive information contrary to law or listing requirements;
  • manipulate task, referral, review, rating, reward, payout or marketplace systems;
  • create duplicate accounts to evade limits, sanctions or enforcement;
  • scrape, probe, attack, overload, reverse engineer or bypass security/access controls except where such restriction is prohibited by law;
  • introduce malware, destructive code or unsafe files;
  • use purchased data outside the applicable license;
  • use CrowdifAI or its datasets to violate privacy, discrimination, export-control, sanctions, intellectual-property or other applicable law;
  • impersonate another person or organization;
  • make misleading claims about dataset provenance, quality, consent, anonymity or legal compliance; or
  • interfere with another user’s access to the Service.

19. Intellectual-property complaints

If you believe material on CrowdifAI infringes your rights, send a notice to [IP/LEGAL EMAIL] containing sufficient information to identify the protected work/right, the challenged material, your contact details, the basis of your claim and any declaration required by applicable law.

We may disable access while investigating and may terminate repeat or serious infringers where appropriate.

20. Privacy, personal data and confidentiality

Our Privacy Policy explains how CrowdifAI handles account information, uploaded data, KYC information, transaction records, device/security data, file metadata and other personal data.

Buyers and creators are independently responsible for determining whether their use of a dataset involves personal data, confidential information or regulated data and for satisfying their own legal obligations. A CrowdifAI listing, automated scan, preview or moderation status is not a substitute for the buyer’s or creator’s own compliance assessment.

21. Third-party services

CrowdifAI may rely on third-party services such as payment processors, payout providers, identity-verification providers, cloud/object storage, email, notification delivery, mobile operating-system providers and app stores.

Those providers may have separate terms. CrowdifAI is not responsible for an independent third party’s service interruption or decision except to the extent liability cannot be excluded under applicable law.

22. Suspension and termination

You may stop using CrowdifAI and request account deletion at any time, subject to outstanding transactions, lawful retention and any separate enterprise contract.

CrowdifAI may restrict, suspend or terminate access where reasonably necessary because of:

  • material or repeated violation of these Terms;
  • suspected fraud, chargebacks, payment abuse or false KYC;
  • rights/privacy violations;
  • security threats;
  • legal or regulatory requirements;
  • sanctions/payment-provider restrictions; or
  • conduct creating material risk to users or the platform.

Where appropriate and legally required, we will provide notice and an opportunity to appeal or cure.

Termination does not erase accrued payment obligations, valid licenses already granted, dispute records, tax/accounting records, or provisions that by their nature should survive.

23. Service availability and changes

We may improve, modify, suspend or discontinue features. We will provide notice of material changes where reasonably practicable or legally required.

We do not guarantee uninterrupted availability, a particular dataset, a particular task, a minimum number of buyers, or permanent availability of third-party services.

24. Dataset and AI-use disclaimer

Unless an order expressly states a specific warranty, datasets are provided subject to the description and mandatory conformity rights applicable to the transaction.

Machine-learning data can contain errors, bias, duplicates, omissions, labeling differences, outdated information or other limitations. You are responsible for validating whether a dataset is appropriate for your intended model, research, production system, regulatory environment and risk profile.

CrowdifAI does not guarantee a particular model accuracy, business result, safety outcome, regulatory approval or absence of bias merely because a dataset is available through the Service.

25. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided on an “as available” basis and CrowdifAI disclaims implied warranties that may lawfully be excluded.

This section does not exclude statutory guarantees, digital-content conformity rights, fraud liability, liability for wilful misconduct, or other rights/liabilities that applicable law does not permit us to exclude.

26. Limitation of liability

To the maximum extent permitted by law, CrowdifAI will not be liable for indirect, incidental, special or consequential losses, lost profits, lost opportunities or loss of data arising from use of the Service, except where such limitation is prohibited by law.

For non-consumer claims where a monetary cap is legally enforceable, CrowdifAI’s aggregate liability arising from the event giving rise to the claim will not exceed the greater of:

  1. the amount you paid to CrowdifAI for the affected transaction or Service during the 12 months before the event; or
  2. [LIABILITY FLOOR, e.g. EUR 100].

The cap does not apply where law prohibits limitation, including as applicable for death/personal injury caused by negligence, fraud, wilful misconduct, mandatory privacy/data-protection liability or non-excludable consumer rights.

Counsel must confirm this clause for the operator’s jurisdiction before publication.

27. Indemnity for business/creator misuse

If you use CrowdifAI for business purposes or act as a creator/seller, you agree, to the extent permitted by law, to defend and indemnify CrowdifAI against third-party claims and reasonable costs arising from your unlawful User Content, your breach of rights/licensing warranties, your misuse of purchased data, or your material breach of these Terms.

This clause does not apply to ordinary consumers to the extent prohibited by consumer law and does not cover losses caused by CrowdifAI’s own unlawful conduct.

28. Changes to Terms

We may update these Terms for legal, security, product or business reasons. We will identify the effective date and provide notice of material changes as required by law.

Where a change materially affects existing contractual rights and consent is legally required, we will request renewed acceptance. We will not rely solely on continued use where the law requires affirmative agreement.

Changes do not retroactively alter a completed dataset purchase or already-granted license unless the applicable agreement, law or the parties expressly permit it.

29. Governing law and disputes

These Terms are governed by the laws of [GOVERNING LAW JURISDICTION], excluding conflict-of-law rules, subject to mandatory consumer protections in your country of residence.

Courts located in [COURT LOCATION] will have jurisdiction for disputes where such choice is legally valid. Consumers retain any right to bring proceedings in their home jurisdiction where mandatory law provides it.

Before filing a claim, you may contact [LEGAL/SUPPORT EMAIL] so we can attempt to resolve the matter informally. This does not shorten or waive a statutory limitation or complaint period.

30. General terms

If one provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver. You may not transfer your account or agreement without our consent, except where applicable law permits it. We may transfer these Terms as part of a merger, restructuring or sale of the Service, subject to applicable notice/data-protection obligations.
